Rivana is a Novadyne product. Infai Tech Corporation ("Infai Tech Corp", "we", "us", or "our") operates the Rivana website and software under the Novadyne brand. This policy describes how we collect, use, and protect your information.

Information We Collect

Website Contact Form: When you submit our contact form, we collect:

  • Company name (optional)
  • Number of servers you wish to monitor
  • Your message

Spam Protection: We use Cloudflare Turnstile to prevent automated spam submissions. Cloudflare may collect technical data as described in their privacy policy.

How We Use Your Information

We use contact form submissions solely to:

  • Respond to your inquiries
  • Provide trial licenses and product information
  • Communicate about your license or support requests

We do not sell your personal information to third parties.

Rivana Software

Rivana is self-hosted software that runs entirely within your infrastructure. No monitoring data, device information, or metrics are transmitted to Infai Tech Corp. All data collected by Rivana remains on your servers under your control.

Data Retention

We retain contact form submissions for as long as necessary to fulfill your request and maintain our business relationship. You may request deletion of your data at any time.

Terms of Service

License Grant

Subject to payment of applicable fees and compliance with these terms, Infai Tech Corp grants you a non-exclusive, non-transferable license to use the Rivana software for the number of storage devices specified in your license.

Restrictions

You may not:

  • Reverse engineer, decompile, or disassemble the software
  • Redistribute, sublicense, or resell the software
  • Remove or alter any proprietary notices
  • Use the software beyond your licensed device count
  • Share license files with third parties

Support

Support is provided according to your license tier. All licenses include email support. Response times and additional support options vary by tier as described on our pricing page.

Updates

Licensed users receive software updates and security patches for the duration of their license term. Updates are provided at our discretion and may include new features or bug fixes.

Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability

IN NO EVENT SHALL INFAI TECH CORP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Termination

We may terminate your license if you breach these terms. Upon termination, you must cease using the software and destroy all copies. Sections regarding liability, warranties, and governing law survive termination.

Governing Law

These terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Nevada.

Changes to Terms

We may update these terms from time to time. Continued use of the software after changes constitutes acceptance of the new terms.
